These Terms & Conditions (the “Terms”) form a binding agreement between you and Orthodate (“Orthodate”, “we”, “us”) and govern your use of the Orthodate website, applications and related services (together, the “Service”). By creating an account or otherwise using the Service you confirm that you accept these Terms. If you do not accept them, do not use the Service.

You may use the Service only if you are at least 18 years old, are legally able to enter into a contract with us, and have never been convicted of a felony, a sex offence or any violent crime. You must not be listed on any sex-offender register. You may hold only one account.

You are responsible for the accuracy of the information you provide and for all activity that happens under your account. Keep your login details confidential and tell us immediately if you suspect unauthorised access. We verify email addresses and, where enabled, mobile numbers in order to reduce fake profiles.

When using the Service you agree not to:

• Impersonate another person or misrepresent your age, identity or affiliation.
• Harass, threaten, defame, stalk or discriminate against other members.
• Post nudity, sexually explicit material, violence, hate speech or anything unlawful.
• Use the Service for commercial solicitation, advertising, spam or financial scams.
• Request or send money, or share financial details with other members.
• Upload photographs of anyone else without their permission, or images of minors.
• Scrape, copy or otherwise harvest member data, or use bots and automated access.
• Attempt to interfere with, probe or compromise the security of the Service.

We may investigate, remove content and suspend or terminate accounts that breach these rules, at our discretion and without prior notice.

You retain ownership of the photos, answers and messages you upload. By posting them you grant Orthodate a worldwide, non-exclusive, royalty-free licence to host, store, reproduce and display that content solely for the purpose of operating, improving and moderating the Service. This licence ends when you delete the content or your account, except for copies retained in backups or where retention is required by law.

Parts of the Service are, or may become, available only through a paid subscription. Prices and features are shown at the point of purchase. Subscriptions renew automatically for successive periods at the then-current price unless you cancel before the end of the current period. You can cancel at any time through the store or billing portal you used to subscribe; cancellation stops future renewals but does not retroactively refund the current period.

Where you are a consumer in a jurisdiction that grants a statutory withdrawal or refund right, that right applies in addition to the above. Purchases made through the Apple App Store or Google Play are also subject to that store’s refund policy. We may change prices with reasonable notice; changes take effect at the next renewal.

Orthodate does not conduct criminal background checks on members. You are solely responsible for your interactions with other members. Take sensible precautions: meet in public places, tell someone where you are going, never send money, and report anyone who makes you uncomfortable. Report concerns through our contact form.

The Service, including its software, design, text, graphics and trade marks, belongs to Orthodate or its licensors and is protected by intellectual-property laws. You may not copy, modify, distribute, sell or create derivative works from any part of the Service without our written permission.

You may stop using the Service and delete your account at any time from your account settings. We may suspend or terminate your account if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including sections 5, 8, 10, 11 and 12) will continue to apply.

The Service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that profiles are accurate, or that you will find a match.

To the extent permitted by law, Orthodate will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from your use of the Service. Our total aggregate liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or fifty euros (€50). Nothing in these Terms excludes liability that cannot lawfully be excluded.

We may update these Terms from time to time. Material changes will be announced in the app or by email before they take effect, and continued use after that date means you accept the revised Terms. These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-law rules, and you agree to the exclusive jurisdiction of the competent courts there, unless mandatory consumer-protection law in your country of residence provides otherwise.
